Miami-Dade Accessory Dwelling Unit (ADU)

Miami-Dade County allows single-family homes to have an Accessory Dwelling Unit (ADU)

Miami-Dade County has approved an ordinance, allowing an accessory dwelling unit (ADU) or guesthouse in a single-family zoned district either as a newly detached or attached dwelling unit, including the conversion of a portion of an existing single-family dwelling.

The County Code imposes certain restrictions and conditions on the allowance for an ADU or guesthouse to ensure neighborhood compatibility, design compatibility, and management of parking needs. For more information on accessory units, please see section 33-22 of the County Code.

What is an ADU?

An ADU is an addition to a single-family home with a separate entrance from the primary unit that is intended for use by a separate family of occupants. The ADU has it’s own kitchen, bathroom, and sleeping area and can be rented by the owner of the property. 

What are the requirements to comply with an ADU?

  • One accessory unit per lot shall be permitted in the following zoning districts located inside of the Urban Development Boundary: AU, EU, and RU, as well as GU for properties that are trended to AU, EU, or RU.
  • Occupant does not have to be the family of the occupant of the primary structure.
  • Can be rented for a fee.
  • Can have a separate address, entrance, and/or separate utilities from the principal structure.
  • May be attached or detached to the primary residence.
  • Lot size must be a minimum of 7,500 Sq ft, and the dwelling size must be between 400-800 Sq ft in RU-1 districts.
  • Setback requirements still apply for detached structures.
  • An ADU is not a duplex and cannot be sold independently of the principal building.
  • Only the owner of the property may obtain a certificate of use (CU) for an ADU.
